This document describes the privacy policy of the website located at www.atafinance.pl, whose Administrators are entities constituting the ATA Finance Group, including: ATA Tax Sp. z o.o. and ATA Accounting Services Sp. z o.o. Sp. k. The registered office of the companies comprising ATA Finance is located in Warsaw at al. Armii Ludowej 26 (hereinafter referred to as ATA Finance).
    2. The purpose of the Policy is to define the principles and methods of processing and using data and information from website users, as well as to provide information regarding the rights of individuals concerning the personal data they provide.
    3. Please carefully review the contents of this policy. By accessing or using this website and providing us with any personal data, the user accepts the terms of this privacy policy.
    4. Please note that by leaving this site (e.g., by following a link to a site in a different domain), the user enters an area where this privacy policy does not apply. ATA Finance is not responsible for the privacy policy rules applicable on websites operated by other entities.
  2. Personal Data Protection Principles
    ATA Finance is the data controller for personal data provided by users on websites operated by ATA Finance. ATA Finance takes special care to ensure that all personal data is processed in accordance with the purpose for which it was collected and used in accordance with the permissions granted (consents) and processing areas allowed by law.
  3. Purpose of Personal Data Processing
    1. Each person providing personal data to ATA Finance through forms on the website is informed of the specific purpose for which this data is processed and the legal basis for processing.
    2. ATA Finance uses personal data only for the specified purposes. In particular:
      1. in the case of consent to contact through the contact form for contacting a representative of ATA Finance regarding ATA Finance products or services.
      2. in the case of consent to receive newsletters sent by ATA Finance.
    3. Personal data processed based on consent will be processed until it is withdrawn or the purpose for which the data was collected ceases. Consent given may be withdrawn at any time without affecting the lawfulness of processing carried out based on consent prior to its withdrawal. Data processed in connection with the conclusion and performance of a contract will be processed in accordance with applicable regulations, but no longer than until the expiration of the period in which ATA Finance may assert claims related to the concluded contract, unless a longer period is required by the Accounting Act.
  4. Security and Storage of Information
    1. ATA Finance ensures the security of personal data through appropriate technical and organizational measures to prevent unauthorized processing of data and their accidental loss, destruction, or damage.
    2. ATA Finance takes special care to ensure that personal information is:
      • processed lawfully, fairly, and transparently,
      • collected for specified, explicit, and legitimate purposes and not further processed in a manner incompatible with those purposes;
      • adequate, relevant, and limited to what is necessary for the purposes for which it is processed;
      • accurate and, where necessary, kept up to date;
      • kept in a form that permits identification of the data subject for no longer than is necessary for the purposes for which the personal data is processed;
      • processed in a manner that ensures appropriate security of personal data;
      • with the provision of the realization of the rights of data subjects;
      • not transferred without appropriate protection to countries outside the European Economic Area or international organizations.
  5. Data Acquisition
    1. When collecting any personal data, ATA Finance records where they were first obtained.
    2. Personal data is collected through:
      • online forms – information is collected through various forms available on the website, used for contact purposes, submitting questions, or providing feedback;
      • offline contact – ATA Finance websites contain various phone numbers, fax numbers, and email addresses for contacting us directly;
      • data on traffic and statistics regarding the frequency of visits to ATA Finance websites – information about traffic data is recorded automatically by our server, such as the user’s IP address, URLs visited before and after visiting our website, and visited pages. Statistics on the number of visits to the site and page views are also collected. ATA Finance cannot directly identify the user based on traffic data and usage statistics.
      • while using resources of the website managed by ATA Finance – information about users is collected through files such as “cookies.” Cookies – small text files transferred from a website and stored on the user’s hard drive used to customize content and services to individual needs and interests of ATA Finance website users. They allow the site to “remember” who you are. Users can disable the option to accept cookies in their browser at any time, but the result of such a change may be the loss of the ability to use the ATA Finance website.   6. User Rights
    1. ATA Finance respects the rights of individuals related to the processing of their personal data. In particular, each person whose data is processed has the right to:
      1. obtain information about the processing of their personal data,
      2. the right to access data, request their rectification, completion, and change,
      3. the right to erasure of data (“the right to be forgotten”),
      4. the right to restrict data processing,
      5. the right to data portability,
      6. the right to object to the processing of their data for legitimate purposes by ATA Finance as the data controller, including direct marketing of its products and services and profiling, as well as the right not to be subject to a decision based solely on automated processing.
    2. ATA Finance reserves that if it is not possible to absolutely identify the person, for example, due to the scope of data provided by them, it may refuse to take action at the request of the person whose data it is, informing them about it unless that person provides additional information allowing their identification.
    3. ATA Finance informs that it is not obliged to delete data (“the right to be forgotten”) when processing is necessary for:
      1. exercising the right to freedom of expression and information,
      2. compliance with a legal obligation requiring processing under Union or Polish law, or the performance of a task carried out in the public interest,
      3. archival purposes in the public interest, scientific or historical research purposes, or statistical purposes,
      4. establishing, investigating, or defending claims.
    4. If a user objects to further processing for marketing purposes, profiling, or transferring personal data to another data controller, the objection is taken into account. However, the data controller may retain in the collection data identifying a natural person solely to avoid reusing the data of that person for purposes covered by the objection.
    5. The user may exercise the right to information and access to data no more frequently than once every 6 months. Upon the request of the data subject, the data controller is obliged, within 30 days, to provide the necessary information.
  7. Scope of User Data Sharing
    ATA Finance declares that it does not sell or lend collected personal data of users to other individuals or institutions unless it is done with explicit consent or at the request of the user, or at the request of authorized state authorities for the purposes of proceedings or actions related to security or defense, for specific legally justified purposes of ATA Finance.
  8. Changes to the Privacy Policy
    Changes to the ATA Finance privacy policy may be influenced by changes in the legislative sphere regarding the protection of personal data, as well as other factors.
